Throughout these Terms, “we”, “us” and “our” refer to 3Cube UK Ltd trading as CottonBags.uk.
These Terms apply to purchases made through CottonBags.uk. Please read them before placing an order.
2. Our Products
We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.
Colours may appear slightly different depending on your screen or device. For products made from natural materials such as cotton, canvas or jute, minor variations in colour, weave, texture, dimensions or finish may occur and are part of the natural characteristics of the material.
Nothing in these Terms affects your statutory rights where goods are faulty, not as described or otherwise do not meet the requirements of UK consumer law.
3. Prices
Prices displayed on our website are shown in pounds sterling (£).
Where applicable, prices shown to consumers include VAT at the prevailing rate unless clearly stated otherwise.
Any applicable delivery charge will be displayed before you complete your order.
We may change our prices at any time, but changes will not affect an order that we have already accepted.
4. Placing an Order
When you place an order through our website, you are offering to purchase the products in your order.
After you place an order, we may send an acknowledgement confirming that we have received it. This does not necessarily mean that your order has been accepted.
A contract is formed when we accept your order and confirm that it is being processed or dispatched.
We reserve the right to decline or cancel an order where reasonably necessary, for example where a product is unavailable, there is an obvious pricing or description error, payment cannot be authorised, or we reasonably suspect fraud.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.
5. Payment
Payment must be made using one of the payment methods available at checkout.
You confirm that you are authorised to use the payment method provided.
Your order may be subject to payment verification and fraud-prevention checks.
6. Delivery
Available delivery methods, charges and estimated delivery times will be shown during checkout where applicable.
We will make reasonable efforts to deliver within the estimated timeframe provided.
For consumer orders, unless a different delivery period has been agreed with you, goods will normally be delivered without undue delay and within 30 days of the contract being formed.
Please ensure that your delivery address is complete and accurate.
If delivery is delayed for reasons outside our reasonable control, we will contact you where appropriate and take reasonable steps to minimise the delay.
7. Your Right to Cancel
If you are a consumer purchasing online, you normally have a statutory right to cancel your order without giving a reason within 14 days after receiving the goods, subject to the exceptions provided by law.
After notifying us that you wish to exercise your statutory right to cancel, you should return the goods within the applicable statutory return period.
This statutory cancellation right is separate from any additional returns period that we voluntarily offer.
Full details are provided in our Return & Refund Policy.
UK distance-selling rules provide the 14-day cancellation right and generally require returned goods to be sent back within a further 14 days.
8. Our Additional 30-Day Returns Policy
In addition to your statutory rights, we offer a 30-day returns period from the date you receive your order, subject to the conditions in our Return & Refund Policy.
For a return under this additional policy, products must generally be unused, unworn and in their original condition.
Our voluntary 30-day returns policy does not reduce or replace your statutory consumer rights.
9. Customised and Personalised Products
Products that are made to the customer's specifications or are clearly personalised — including products printed, embroidered, manufactured or otherwise customised specifically for the customer — will not normally qualify for the statutory change-of-mind cancellation right.
This does not affect your rights if customised or personalised goods are faulty, damaged, not as described or otherwise do not conform to the contract.
UK guidance specifically recognises bespoke and customised goods as an exception to the usual distance-selling cancellation right.
10. Faulty, Damaged or Incorrect Goods
Products supplied to consumers must meet the requirements of the Consumer Rights Act 2015, including being of satisfactory quality, fit for purpose where applicable and as described.
If you receive an incorrect, damaged or faulty product, please contact us at info@3cube.co.uk.
Where you are legally entitled to a remedy, we will provide the appropriate remedy in accordance with your statutory rights.
Nothing in these Terms limits or excludes those rights.
11. Return Costs and Refunds
For change-of-mind returns, you may be responsible for the direct cost of returning the goods, as explained in our Return & Refund Policy and subject to your statutory rights.
Where goods are faulty, damaged, incorrect or otherwise not as described, we will deal with return costs in accordance with applicable consumer law.
Approved refunds will normally be made using the original payment method.
Please refer to our Return & Refund Policy for full details.
12. Business Customers
Some customers may purchase products from us wholly or mainly for business purposes.
Consumer rights described in these Terms apply where the purchaser is acting as a consumer. Different legal rules may apply to purchases made wholly or mainly for business purposes.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
13. Our Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot lawfully be excluded under applicable consumer protection legislation.
If you are a consumer, we are responsible for losses that are a foreseeable consequence of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was made.
If you use products for commercial or business purposes, different limitations permitted by law may apply.
UK consumer contracts cannot simply exclude responsibility for matters such as faulty or misdescribed goods, and contract terms must be fair and transparent.
14. Intellectual Property
Unless otherwise stated, the content of CottonBags.uk, including our website design, text, photographs, graphics, logos and other original content, belongs to us or is used by us with permission.
You may not reproduce, distribute, commercially exploit or use our protected content without permission except where permitted by law.
Third-party trademarks and other intellectual property remain the property of their respective owners.
15. Customer Artwork and Custom Printing
Where you provide artwork, logos, text, designs or other material for printing, embroidery or customisation, you confirm that you have the necessary rights or permission to use that material and to instruct us to reproduce it.
You are responsible for checking artwork, spelling, colours, dimensions and other specifications before approving a proof where a proof is supplied.
Where production accurately follows artwork or a proof approved by you, we will not normally be responsible for errors contained in the approved artwork or proof. This does not affect any rights you may have where we have failed to manufacture the goods according to the agreed specification.
16. Privacy
We process personal information in accordance with our Privacy Policy and applicable data-protection law.
Please refer to the Privacy Policy available on our website for information about how personal information is collected, used and protected.
17. Events Outside Our Reasonable Control
We will not be responsible for a failure or delay in performing our obligations where this results from circumstances outside our reasonable control.
Where such circumstances materially affect an order, we will take reasonable steps to minimise the impact and will contact you where appropriate.
Nothing in this section affects any statutory rights you may have.
18. Changes to These Terms
We may update these Terms from time to time, for example to reflect changes to our business, website or applicable law.
The Terms applicable to your purchase will normally be those in effect when your order is placed.
19. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you will retain any mandatory protections provided to you by applicable law and may have the right to bring proceedings in the courts applicable to where you live.
